Protected Species

This term is usually used to refer to the species protected by European legislation or reference may be made to the European Protected Species (EPS). Species include all UK bats, great crested newt, otter, common dormouse, white clawed crayfish and large blue butterfly.

In August 2009 Natural England released a policy and advice statement based on a Judicial Review Judgment in the case of Woolley V. Cheshire East Borough Council and Millennium Estates Ltd. This statement puts the onus on loca l planning authorities to ensure that any proposed development meets the requiremen ts of article 16 of the EC Habitats Directive. Therefore local authorities must give regard to the purpose for the resultant EPS Licence(s), and the tests must be met, namely:


  • "that there is no satisfactory alternative" and that
  • the action authorised will not be detrimental to the maintenance of the population of the species concerned at favorable conservation status in their natural range.

Once their presence on site has been identified, the population size and status must be determined to enable assessment of the proposed activities and requirements for mitigation/ compensation.

Note: An EPS licence may not always be required when working on a building containing a bat roost.
